Terms & Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:

Withdrawal period: the period during which the consumer may exercise the right of withdrawal;

Consumer: the natural person who is not acting in the course of a professional or commercial activity and who enters into a distance contract with the entrepreneur;

Day: calendar day;

Continuous performance contract: a distance contract relating to a series of products and/or services, whereby delivery and/or acceptance obligations are spread over time;

Durable medium: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;

Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the withdrawal period;
-
Entrepreneur: the natural or legal person offering products and/or services to consumers at a distance;
-
Distance contract: a contract concluded within the framework of an organized system for distance selling of products and/or services, whereby exclusive use is made of one or more distance communication techniques up to and including the conclusion of the contract;

Distance communication technique: any means that can be used to conclude a contract without the consumer and entrepreneur being simultaneously present in the same location;
-
General Terms & Conditions: the present General Terms & Conditions of the entrepreneur.
Article 2 – Scope
These General Terms & Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these General Terms & Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated prior to the conclusion of the contract that the General Terms & Conditions can be consulted at the entrepreneur’s premises and will be sent free of charge upon request.
If the distance contract is concluded electronically, the text of these General Terms & Conditions may be made available electronically in such a way that it can be easily stored on a durable medium. If this is not reasonably possible, the consumer will be informed where the terms can be consulted electronically and that they will be sent free of charge upon request.
If specific product or service conditions apply in addition to these General Terms & Conditions, the above provisions apply accordingly. In the event of conflicting conditions, the consumer may always rely on the provision most favorable to them.
If one or more provisions of these General Terms & Conditions are wholly or partially void or annulled at any time, the remaining provisions shall remain in force. The invalid provision shall be replaced by a provision that most closely reflects the original intent.
Situations not covered by these General Terms & Conditions shall be assessed in accordance with their spirit. Any ambiguity regarding interpretation shall likewise be interpreted in accordance with their intent.
Article 3 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be expressly stated.
All offers are non-binding. The entrepreneur reserves the right to modify or adjust the offer.
The offer includes a complete and accurate description of the products and/or services offered. Images are a true representation of the products; however, minor deviations may occur. Obvious errors or mistakes do not bind the entrepreneur.
All images, specifications, and data are indicative and cannot give rise to compensation or contract termination.
Each offer clearly states:

the price, excluding customs duties and import VAT (payable by the customer);

any shipping costs;
-
how the contract is concluded;
-
whether a right of withdrawal applies;
-
payment, delivery, and execution methods;
-
the validity period of the offer;
-
applicable communication costs (if different from base rate);
-
contract archiving and accessibility;
-
available languages;
-
applicable codes of conduct;
-
minimum duration for continuous performance contracts.
Optional: available sizes, colors, materials.
Article 4 – The Contract
The contract is concluded when the consumer accepts the offer and complies with its conditions.
Electronic acceptance is confirmed immediately. Until confirmation is received, the consumer may cancel the contract.
Appropriate security measures are taken for electronic transactions. The entrepreneur may assess the consumer’s ability to meet payment obligations and may refuse an order with justification.
The entrepreneur will provide the consumer with:

contact details for complaints;
-
withdrawal conditions or exclusion thereof;
-
warranty and after-sales information;
-
termination conditions if applicable.
Contracts are subject to product availability.
Article 5 – Right of Withdrawal
Consumers may withdraw from the contract within 14 days of receiving the product.
Products must be handled carefully and returned with all accessories, preferably in original packaging.
Consumers must notify withdrawal within 14 days and return the product within another 14 days, providing proof of shipment.
Failure to comply makes the sale final.
Article 6 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer.
Refunds will be processed within 14 days after withdrawal, provided the product has been received or return proof supplied.
Article 7 – Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for:

custom-made or personalized products;
-
perishable goods;
-
sealed hygiene products once opened;
-
audio/video/software with broken seals;
-
newspapers and magazines;
-
services performed with prior consumer consent;
-
betting and lottery services.
Article 8 – Prices
Prices remain unchanged during the offer period, except for VAT changes.
Variable prices linked to financial markets may apply.
Price increases within three months are only allowed if legally required.
Delivery occurs outside the EU; import VAT and customs fees may apply. No VAT is charged by the entrepreneur.
Typographical errors are not binding.

Article 10 – Conformity and Warranty
Products comply with the agreement and legal standards. Manufacturer warranties do not affect statutory consumer rights.
Defects must be reported within 14 days. Warranty excludes misuse, unauthorized repairs, or abnormal conditions.
Article 11 – Delivery and Execution
Orders are executed with care and delivered within 30 days unless agreed otherwise.
Delays entitle the consumer to cancel and receive a refund within 14 days.
Risk transfers upon delivery.
Article 12 – Continuous Performance Contracts
Consumers may terminate indefinite contracts with one month’s notice. Fixed-term contracts may be terminated at expiry.
Trial subscriptions end automatically.
Article 13 – Payment
Payments are due within 7 business days. Incorrect payment details must be reported immediately.
Late payments may incur reasonable costs.
Article 14 – Complaints
Complaints must be submitted within 7 days and will be handled within 14 days.
Unresolved disputes may be brought before a court.
Article 15 – Disputes
All agreements are governed exclusively by Dutch law.
Article 16 – CESOP
Under EU regulations effective from 2024, payment service providers may record transaction data in the European CESOP system.
